1 Acceptance of Terms
These Terms and Conditions govern your use of all mobile applications and services developed and provided by Cem Print and Marketing LLC, including FolioTrax and any future applications. By using FolioTrax, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
2 Description of Service
Cem Print and Marketing LLC develops and publishes mobile applications for iOS, including the personal portfolio tracking app FolioTrax. Our applications allow users to track and manage financial information. They are tracking tools only — they do not execute trades, manage investments, or provide regulated financial services of any kind.
FolioTrax is offered in two tiers:
- Free Plan: Manual price entry, limited accounts and assets (1 broker, 1 bank, 1 savings & CD, 1 loan, 3 subscription trackers, 3 custom assets, 1 Family Share)
- Pro Subscription: Automatic price updates (may be delayed), unlimited accounts and assets, and all premium features including Dividend Forecast, Portfolio Health, Tax Report, Price Alerts, Rebalancing, Timeline, Watchlist, Retirement Simulator, and Family Share beyond the free limit
3 Free Trial
New users receive a 7-day free trial with full Pro access upon first installation. No credit card is required for the trial. At the end of the trial period, the account automatically reverts to the Free Plan unless a Pro subscription is purchased through the App Store.
4 Subscriptions and Billing
Pro subscriptions are offered on a monthly ($3.99/month) or annual ($29.99/year) basis. Subscriptions are processed by Apple through the App Store and are subject to Apple's terms and conditions. Cem Print and Marketing LLC does not process payments directly.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You may manage or cancel your subscription through iPhone Settings → Apple ID → Subscriptions.
4b Effect of Trial Expiry or Cancellation
When your trial expires or you cancel a Pro subscription: (a) All data you have entered is permanently retained — FolioTrax never deletes your data. (b) Accounts and assets beyond free plan limits become locked — visible and deletable but not editable. (c) Automatic price updates stop. (d) Pro features are disabled. (e) Resubscribing to Pro immediately restores full access to all non-deleted locked items.
5 No Financial Advice
FolioTrax does not provide financial, investment, tax, legal, or accounting advice. Nothing in the application constitutes a recommendation to buy, sell, or hold any investment. All decisions are made solely by the user. Please refer to our full Risk Warning for complete disclosures.
6 Data and Privacy
Your use of FolioTrax is also governed by our Privacy Policy, which is incorporated into these Terms by reference. FolioTrax stores data locally on your device. We do not sell, rent, or share your personal data with third parties for commercial purposes.
7 Acceptable Use
You agree not to:
- Use FolioTrax for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, or disassemble the application
- Use the application to transmit harmful, offensive, or fraudulent content
- Attempt to gain unauthorized access to any systems or networks connected to FolioTrax
- Use the application in any way that could damage, disable, or impair its functionality
8 Intellectual Property
All content, design, code, trademarks, and intellectual property in our applications are owned by or licensed to Cem Print and Marketing LLC. You are granted a limited, non-exclusive, non-transferable license to use the application for personal, non-commercial purposes only. You may not copy, modify, distribute, or create derivative works without our express written permission.
9 Disclaimer of Warranties
Our applications are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the application will be error-free, uninterrupted, or that data will be accurate or current. We expressly disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
10 Limitation of Liability
To the maximum extent permitted by law, Cem Print and Marketing LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, investments, or goodwill, arising from your use of any of our applications or reliance on any information displayed therein.
11 Termination
We reserve the right to terminate or suspend access to any of our applications at any time without notice if we believe you have violated these Terms. Upon termination, your right to use the application ceases immediately. Data stored locally on your device remains under your control.
12 Changes to Terms
We may update these Terms from time to time. We will notify users of material changes through the application. Your continued use of FolioTrax after any changes constitutes acceptance of the updated Terms.
13 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Florida.
